Over the weekend a video featuring Selena Solis, the judge overseeing the malpractice case against El Paso Children’s Hospital by David Saucedo and his wife over the death of their child, was posted to TikTok. The video posted by Sammy Carrejo on his Sammy C Show channel shows that Solis attended an event held by the El Paso Children’s Hospital Foundation.

The El Paso Children’s Hospital Foundation is a non-profit organization whose mission is to support the El Paso Children’s Hospital. In 2020, David Saucedo and his wife filed a malpractice lawsuit against El Paso Children’s Hospital over the death of their child. The suit alleges the hospital was negligent in the treatment of their child.

Selena Solis was the judge overseeing the civil case until yesterday.

Since its filing, the court case has been mired in controversy over whether court documents should be removed from the public record.

Included in the lawsuit filing was an affidavit by Thomas Mayes, a doctor who oversaw other doctors working at the children’s hospital. In the affidavit, Mayes disclosed that one of the doctors who oversaw the treatment of the child that died at the hospital “presents a real danger to his patients and should be removed from the practice of medicine.” Read affidavit here.

On January 19, 2022, after holding several hearings about how to remove the affidavit from the public record, Solis ordered that the Mayes affidavit be removed from the public court record.

Yesterday in the afternoon, Selena Solis issued a one-page order recusing herself from the children’s malpractice case. Solis does not explain why she recused herself in her order, other than to explain “that a conflict of interest has arisen over the case.”

According to the El Paso Children’s Foundation’s Facebook page, the event that Solis participated in was held on August 17.

Solis was first elected to the 243rd judicial district seat in 2018. She is up for reelection on November 3, 2026.

The Saucedo malpractice case is not the only lawsuit recently filed against the El Paso Children’s Hospital involving the death of children under their care. There have been several cases filed in recent months.
