El Paso defense attorneys Stuart Leeds and Theresa Caballero were in the process of delivering their closing statements in their contempt trial Saturday morning when the prosecution asked for a brief break.

The prosecutor, Bell County District Attorney Henry Garza, is expected to begin his closing argument following the conclusion of attorney Caballero’s summation after the break.

The two prominent attorneys, who have been arguing their case since Monday, urge Visiting Judge Juanita Vasquez-Gardner to consider the fact that the prosecution has failed in its attempt to prove its case, which is the state’s burden.

The attorneys point to a meandering and often contentious testimony from Judge Steve Smith, who filed the original contempt charges, saying the judge contradicted himself and was dishonest when he testified. They allege Judge Smith’s testimony proved their case that there was no contempt committed.
